What is intellectual property?

Intellectual property is the legal phrase used to describe what you create (for example, original song lyrics or an original brand would be intellectual property). Copyright, trade marks, designs, and patents are all examples of intellectual property.

What is copyright?

Copyright is a type of intellectual property right which protects the product of your ideas (not the ideas themselves, which may be protected by confidentiality). Copyright exists to reward the effort invested in creating original 'works' (like lyrics, videos, music, articles, and designs) by giving you the right to control how those works are used.

How do I avoid copyright infringement?

Copyright is handled differently under the laws of different territories, but if you use someone else's content (like lyrics, a logo or picture, or even a short clip of music or video), you probably need a 'licence' (a legal phrase that means a permission to do something that would otherwise not be legal or allowed)."Copyright infringement" is the legal phrase used to describe the illegal use of copyright (for example, using copyright-protected lyrics without a licence). If content is created by someone else and you do not have a licence to use it, then do not use it. Giving credit to the copyright owner or stating that you did not intend to infringe copyright will not act as a valid defence.

Why has my content been taken down?

We may receive take-down requests from people or organisations that own or control intellectual property rights, which we must respond to quickly to comply with the law.

What is a take-down request?

Anyone who owns or controls copyright may submit a take-down request to Musixmatch in relation to content they suspect infringes their copyright. As long as these take-down requests contain certain information, intellectual property law requires Musixmatch to act quickly to disable access to the content that the take-down request identifies as infringing.

What do I do if my copyright has been infringed?

If you believe that your work, or the work of someone you are authorised to represent, is being used on: (i) our website at www.musixmatch.com; (ii) our related application; or (iii) any services offered in relation to our website and application, without your authorisation, you can submit a take-down request by following the procedure below.

1. Send your take-down request to gc@musixmatch.com. The request must include:

  • a statement that you have identified content which infringes your work, or the work of a third party on whose behalf you are entitled to act;
  • details of the content you believe is infringing your work, including the location of that content (for example, the URL);
  • a description of the copyright work that you believe is being infringed;
  • your contact information (including email address, physical address, and telephone number);
  • a statement (which you must write is made “under penalty of perjury”) that you believe in good faith that the use of the content is not authorised by the copyright owner, its agent, or the law;
  • a statement (which you must write is made “under penalty of perjury”) that the information in your take-down request is accurate and that you are the owner of, or otherwise authorised to act on behalf of the owner of, the work that you believe is being infringed; and
  • your physical or electronic signature (a scanned copy of your signature is acceptable).

2. It is our policy to: (i) take down content that we believe in good faith to be infringing; (ii) notify the provider of the content that it has been taken down; and (iii) terminate repeat offenders’ use of Musixmatch.

3. If you believe that the copyright of someone else on whose behalf you are not authorised to act is being infringed, you can inform them and direct them to this policy.

4. Before submitting a take-down request, please check that the work which you own or control is registered with the US copyright office and consider whether any fair use exceptions may apply. If you submit a take-down request for content that you know is not infringing, you may have to pay compensation.

What do I do if my content has been taken down?

If you believe that your content is not infringing and was taken down in error, you can appeal that take down by following the procedure below.

1. Send your appeal to gc@musixmatch.com. The appeal must include:

  • details of the content that has been taken down and the location at which the material appeared before it was taken down;
  • a statement from you confirming that you believe in good faith that the content was taken down in error and that it is does not infringe copyright;
  • your contact information (including email address, physical address, and telephone number);
  • your physical or electronic signature (a scanned copy of your signature is acceptable).

2. We may send a copy of your appeal to the person that sent the take-down request.

3. Unless we receive a court order requiring us to restore the content, we will restore it at our discretion.
